Terms and Conditions For Website Design

By proceeding with your order, you are agreeing to the following terms and conditions.

1. Quotation
The prices for products and services shall be as detailed on the quotation delivered to the Client. The Client shall agree to the details as contained in the quotation and approve the quotation before work commence.

2. Payment
Upon approval of the quotation, the advance amount stated on the quotation shall be paid to the website designer. The balance of the amount stated in the quotation will be due on the completion of the website, as agreed by the Client. Payment may be made in cash, cheque, bank transfer or PayPal.

3. Design
Unless otherwise stated, all websites will be built on the wordpress platform. There will be no charge for the use of wordpress platform. The website will utilized pre-designed wordpress templates, licensed or license-free. Unless otherwise stated, the license will be included for the single use of the website.

The design will be built around a pre-designed color template that will provide the professional and elegant look desired by the client while maintaining the cohesiveness of the website.

4. Domain Registration
The client will register one domain for a minimum of one year, which will need to be renewed every year. The registration of the domain may be made by the Client or by the web designer, at the Client’s preference.

5. Web Hosting
If the Client wishes, the web designer will secure a hosting service on behalf of the Client. Standard hosting is registered for 1 year, to be paid in advance and any cancellation will not result in any refund. The preferred hosting for wordpress is hosting with Linux/Cpanel or wordpress hosting.

6. Website Content
The web designer will work with the client to create content for the following pages:

  • Home – This page will be the main page for your website, and will provide the broadest amount of information while maintaining a clean and professional appearance.
  • About Us – Client will provide the appropriate information regarding their company.
  • Contact Us – Contains contact information of the Client and may be linked to a information request form.
  • Internal Pages or Product Pages – These pages will provide information of the Client’s products and services along with other information the Client wish to provide. Products will may be grouped by categories to be determined by the Client.

  • Privacy Policy

All content, including information, videos and graphics will be provided by the Client where available or applicable.

  • Logo – The Client will provide their own logo to web desinger to be used on this project or web designer will reproduce the logo and the Client will be billed.

7. Additional Website Content
In the event when additional content, videos, graphics or logos is unavailable, the services for a graphic designer may be required. Unless stated on the quotation, such services will be charged according, if the Client agrees.

8. Timeline
The dateline of the projects is indicated on the quotation, dependent upon the availability of content. Completion of projects is as defined as in the quotation as agreed upon by the Client. The website is normally completed within 30 days, if the duration of the bill exceeds 30 days through no fault of the web designer, a second installment of part of balance amount will be due. The second installment will be half of the balance due.

9. Copyrights and Trademarks
The Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to the web designer for inclusion in the Client’s web site are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend the web designer from any claim or suit arising from the use of such elements as furnished by the Client.

10. Design Credit
Client agrees that the web designer may put a byline on the bottom of their web site establishing design and development credit with an active hyperlink to the website designer’s website. Client also agrees that the web site created for the Client may be included in the website designer’s portfolio.

11. Transfer of Rights
Until the balance of payment is made, the website and content shall be the intellectual property of the website designer. Upon completion of payment, the domain, hosting and rights of the website shall be transferred to the Client.

12. Cancellation
Cancellation of the project at the request of the Client must be made by letter or email. In the event that work is postponed or canceled at the request of the Client by letter or email, the website designer shall have the right to retain the original payment to cover the website designer for time and expense already invested in the project.

13. Accessibility

The website designer does not warrant that the functions within the website will be uninterrupted or error-free. The entire risk as to the quality and performance of the website lies with the client. In no event will the website designer be liable to the Client or any third party for any damages, including lost profits or other incidentals arising out of the operation of or the inability to operate the website.

14. Website Maintenance
Website maintenance will be the responsibility of Client unless they chose to have the web designer perform maintenance at the monthly rate, to be paid for one year in advance.
